These terms explain how employers, candidates, and AptiaWork work together. We focus on fairness, transparency, and ethical use of AI to support people-first hiring.

Introduction
Welcome to AptiaWork. These Terms of Service ("Terms") govern your use of the AptiaWork platform and services. By accessing or using AptiaWork, you agree to be bound by these Terms.
AptiaWork is an AI-powered hiring assistance platform designed to help small businesses screen job candidates efficiently and ethically. Our service is built on principles of fairness, transparency, and privacy.
Definitions
- Service: The AptiaWork platform, website, and related services
- Employer: Businesses or individuals posting jobs and screening candidates
- Candidate: Job applicants submitting video responses
- AI Analysis: Automated assessments of candidate responses
- We/Us: AptiaWork
Acceptable Use
You Agree To:
- Provide accurate and truthful information
- Comply with applicable employment laws and anti-discrimination regulations
- Use the Service only for lawful hiring and recruitment purposes
- Maintain the security and confidentiality of your account credentials
- Respect candidate privacy and data protection rights
You Agree NOT To:
- Discriminate based on protected characteristics
- Post fake or misleading job listings
- Harass, abuse, or harm candidates or other users
- Reverse-engineer, hack, or compromise the Service
- Use the Service to collect data for unrelated purposes
Employer Responsibilities
- Final Decisions: Employers make all hiring decisions—not AptiaWork or our AI.
- Legal Compliance: Follow all employment laws including Title VII, ADA, ADEA, EPA, FCRA, and state/local regulations.
- Job Postings: Ensure job descriptions are accurate, lawful, and non-discriminatory.
- Fair Use of AI: Treat AI scores as advisory insights, not final decisions.
- Candidate Rights: Offer human review when candidates request it.
Job Posting Duration & Expiry
- Standard Term: Each job posting remains active on the platform for a period of 60 days.
- Automatic Expiry: Upon reaching the 60-day limit, listings will be automatically archived and removed from the public job board and third-party search engines (including Google Jobs).
- No 'Ghost' Jobs: Employers agree to deactivate or mark a position as "Closed" within 48 hours of a role being closed. AptiaWork reserves the right to remove any listing found to be no longer active to maintain platform integrity.
- Third-Party Indexing: While AptiaWork provides the technical data required for indexing (schema markup), we do not guarantee the timing or placement of listings within third-party search engines like Google Jobs, as these are controlled by external algorithms.
AI Limitations and Advisory Nature
Important Notice
AptiaWork is a hiring assistance tool—not a hiring decision-maker. Employers remain responsible for all decisions.
- Advisory Only: AI scores are suggestions, not mandates
- Job-Relevant Factors: AI evaluates communication, enthusiasm, and other job-related qualities
- No Protected Characteristics: AI does not assess legally protected traits
- Potential for Error: We audit regularly but cannot guarantee perfection
- Human Judgment: Pair AI insights with interviews and human review
Account Registration and Security
- Create an account with accurate information
- Protect your credentials and notify us of unauthorized access
- We may suspend or terminate accounts for violations or fraud
Payment and Billing
Pricing
- Job Posts: $29 flat fee per job posting (unlimited candidate screenings included)
Payment Processing
- All payments processed through Stripe
- Valid payment method required to post jobs
- Job fees charged when position closes (manually or automatically after 60 days)
Refund Policy
We generally do not offer refunds due to AI processing and video storage costs. Contact us within 7 days for billing errors.
Intellectual Property
Our IP
AptiaWork software, AI models, content, and branding remain our property. You may not copy, modify, or reverse-engineer them.
Your Content
Employers retain ownership of their job postings and questions; candidates retain ownership of their responses. You give us permission to store and process content to deliver the service.
Disclaimers and Limitation of Liability
AptiaWork is provided "as is" without warranties. We are not liable for indirect damages, lost profits, or hiring outcomes. Our total liability is limited to fees paid in the prior 12 months.
Indemnification
Employers agree to defend and indemnify AptiaWork against claims arising from their hiring practices, job postings, or misuse of the platform.
Data and Privacy
Use of AptiaWork is also governed by our Privacy Policy. By using the service, you agree to our data practices.
Termination
By You
- Close your account anytime
- Active postings close and candidate data is retained 60 days before deletion
- You remain responsible for outstanding fees
By Us
- We may suspend or terminate accounts for violations, fraud, nonpayment, or security risks
Dispute Resolution
Contact us at contact@aptiawork.com to resolve disputes informally. If unresolved, disputes must be filed in our local courts.
Changes to These Terms
We may update these Terms occasionally. We will notify you of material changes; continued use implies acceptance.
Severability & Entire Agreement
If a provision is invalid, the rest remain enforceable. These Terms plus the Privacy Policy represent our complete agreement.
